Terms of Use

By creating an account, accessing or using EdThumb (the "Service"), you confirm that you have read and agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service or, if you are a minor, be authorized and supervised by your parent or legal guardian, who also accepts these terms.

EdThumb is a product of Infowan Soluções em TI Ltda., a Brazilian company registered under CNPJ 53.269.689/0001-10, located at Rua Alceu Amoroso Lima, 668, Sala 1610, Edifício America Towers, Caminho das Árvores, Salvador, BA, ZIP 41820-770, Brazil ("Infowan", "we", "us"). EdThumb is an AI tool for creating YouTube thumbnails. Among other features, it offers:

• more than 300 ready-made styles (templates), organized by category;
• persistent characters, created from photos you upload;
• channel visual identity, learned from reference thumbnails you choose;
• an editor with area, lasso and point selection, numbered adjustments, element moving and versions;
• a variation generator for A/B testing;
• a plugin for use inside ChatGPT.

Images are generated by third-party artificial intelligence models. AI results may vary, contain imperfections or not match your request exactly. Always review the result before publishing.

• You can sign in with your Google account or, when available, with email and password.
• You are responsible for your account information, for keeping your password confidential and for all activity under your account, including by members of your team and by connections you authorize (such as the ChatGPT plugin).
• Let us know immediately at support@edthumb.com if you suspect unauthorized use.

• Using the Service spends credits called EdCoins. Currently, generating a thumbnail costs 5 EdCoins and each edit costs 3 EdCoins. The prices that apply are always the ones shown in the dashboard at the time of use.
• Subscriptions: plans are monthly and renew automatically on the same date each month. Each plan includes an amount of EdCoins per cycle, plus the limits described on the pricing page. The price, what is included and the billing date are shown before you subscribe.
• Plan EdCoins validity: EdCoins included in a plan are valid during the monthly cycle. On renewal, the plan balance is reset to the plan amount; unused plan EdCoins do not roll over.
• Top-up EdCoins: they do not expire while your account is active and are used after your plan EdCoins. EdCoins have no cash value and cannot be transferred to another account or exchanged for money, except in the refund cases set out in these terms or required by law.
• Bonuses and free trials: complimentary, promotional or trial EdCoins follow the rules and validity stated in the offer itself and are not refundable.
• Failures: if a generation or edit fails because of a Service error, no EdCoins are charged: they are only deducted when the image is delivered. If the problem persists, contact support.
• Payments are processed by Stripe. We do not store your full card details.
• Cancellation: you can cancel your subscription at any time from the dashboard or through support, with no fee. Cancelling stops future charges; your access and the EdCoins of the cycle already paid remain available until the end of that cycle.
• 7-day withdrawal right: you can withdraw from your first subscription or EdCoin purchase within 7 days of payment by writing to support@edthumb.com. We confirm receipt of your request immediately and refund the amount to the same payment method, asking the card issuer for the chargeback. If you have already used EdCoins from that purchase during the period, only the amount proportional to the EdCoins spent, which correspond to images already generated at your request, will be deducted.
• After that period, amounts for cycles already started are not refunded, except in case of a Service failure that prevents use or an incorrect charge, which will be refunded in full.
• Prices: we may change prices and plans with at least 30 days notice by email or in the dashboard. The change applies from the following renewal, and you can cancel before it at no cost. Changes do not affect a cycle already paid.

To create characters, you upload photos of faces. By doing so, you represent and warrant that:

• the person pictured is you or someone who has expressly authorized the use of their image for this purpose;
• photos of children and teenagers are only uploaded with the consent of their parent or legal guardian;
• you will not use the Service to impersonate someone, create misleading content about a real person, defame, harass or expose people without consent.

You keep the rights to the photos you upload and grant us a limited, non-exclusive and revocable license to store and process them solely to provide the Service to you. You can delete your characters and photos at any time. How we handle this data is described in the Privacy Policy.

Subject to these terms and to the rights of others, you may freely use the thumbnails generated in your account, including for commercial purposes, in your videos, channels and promotional materials. Infowan does not claim ownership of them and, to the extent it holds any rights in these results, assigns to you, at no additional cost, the rights needed for that use.

The text, photos and other materials you upload remain yours. Copyright protection generally depends on human authorship; therefore, we do not guarantee that AI-generated images are protected by copyright or that you can prevent others from creating similar images.

By their nature, AI models can produce similar results for different requests, so we do not guarantee exclusivity. You are responsible for what you publish, including any text, trademarks, logos and third-party images you ask to include.

The styles, templates, effects, fonts, the EdThumb brand and the Service software belong to Infowan or its licensors and may not be copied or resold separately.

You may not use the Service to create or share content that:

• is sexual and involves minors, or is sexual or intimate content of real people without their consent;
• promotes hate, violence, discrimination, terrorism or illegal activities;
• infringes copyrights, trademarks, image rights or the privacy of others;
• misleads the public about real facts or people (for example, false statements attributed to someone);
• violates the policies of YouTube, ChatGPT or the AI providers we use.

You also may not try to bypass limits, resell access, reverse engineer or overload the Service.

EdThumb uses the YouTube API Services to read public data of the channel you link (such as its name, image and thumbnails). By using this integration, you also agree to the YouTube Terms of Service and acknowledge the Google Privacy Policy.

• The EdThumb plugin for ChatGPT lets you create and edit thumbnails by chatting. To use it, you connect your EdThumb account through an authorization (OAuth) done on our sign-in page.
• Thumbnails and edits made through ChatGPT spend EdCoins from your account, just like on the website, and are saved to your account.
• Your use of ChatGPT is also subject to OpenAI's terms and policies, which are not controlled by Infowan.
• You can disconnect the plugin at any time. See how in Support.

The Service relies on providers such as OpenAI (image generation and text analysis), Google/YouTube, Stripe and hosting and storage providers. Outages at these providers may affect the Service. The list of processors is in the Privacy Policy.

We work to keep the Service available and secure, but it is provided "as is". We do not guarantee specific results in clicks, views or revenue from the generated thumbnails.

To the extent permitted by law, Infowan is not liable for indirect damages, lost profits or content published by users. Nothing in these terms limits rights that consumer protection laws guarantee you.

You can close your account whenever you want. We may suspend or terminate accounts that violate these terms or the law, or that put the Service or others at risk, giving notice whenever possible. After termination, your data is handled as described in the Privacy Policy.

We may update these terms. Material changes will be announced on the website or by email with reasonable notice. Continuing to use the Service after the changes take effect means you agree to the new version.

These terms are governed by the laws of the Federative Republic of Brazil, without prejudice to mandatory consumer protection rules of the country where you live. Disputes may be brought in the courts of the consumer's domicile.

This is a translation of the Portuguese version, provided for your convenience. If there is any conflict between them, the Portuguese version (Termos de Uso) prevails, to the extent permitted by law.
